As part of the use of this website, personal data is processed by us as the controller responsible for data processing and stored for the duration necessary to fulfill the specified purposes and legal obligations. Below we inform you about the data involved, how it is processed, and what rights you have in this regard.

Personal data, according to Art. 4 No. 1 of the General Data Protection Regulation (GDPR), refers to any information relating to an identified or identifiable natural person.

 

1. Name and contact details of the data controller and the company data protection officer

2. Processing of personal data and purposes of processing

a) When visiting the website

You can access the website www.enas.fraunhofer.de without disclosing your identity. The browser used on your device only automatically sends information to the server of our website (e.g. type and version of browser, date and time of access) to enable a connection to the website. This also includes the IP address of your requesting device. This is temporarily stored in a so-called log file and automatically deleted after 4 days.

The processing of the IP address is carried out for technical and administrative purposes of the connection establishment and stability, to ensure the security and functionality of our website and, if necessary, to be able to track down any unlawful attacks on it.

The legal basis for the processing of the IP address is Art. 6 para. 1 sentence 1 lit. f GDPR. Our legitimate interest follows from the aforementioned security interest and the necessity of providing our website without interruption.

From the processing of the IP address and other information in the log file, we cannot draw any direct conclusions about your identity.

In addition, we use tracking pixels and analysis services when you visit our website. Further explanations can be found under section 4 of this privacy policy.

b) When registering for events

We regularly offer events of various kinds through our website, for which you can register online. As part of the registration for an event, some mandatory information must be provided. These include:

  • Salutation
  • First and last name
  • Email address

Any other mandatory information is marked as such (e.g. by means of *). In addition, voluntary additional information can often be provided.

The processing of the mandatory information is carried out in order to identify the interested parties as participants in the event, to process the contract for participation, and to provide participants with information about the event before, during, and after the event. The provision of voluntary data enables us to plan and carry out the event in a way that is appropriate to the interests and age of the participants.

The data processing takes place at the request of the interested participants and is necessary for the fulfillment of the participant contract and pre-contractual measures according to Art. 6 para. 1 sentence 1 lit. b GDPR for the purposes mentioned.

The personal data collected by us for the event will be stored by us for up to 6 months, unless you have consented to storage beyond this period in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR.

As part of the event registration via our web forms, we work together with the service provider Mailingwork GmbH, Birkenweg 7, 09569 Oederan, Germany ("Mailingwork"). The purpose of the collaboration is the professional management of online registrations. To this end, the data entered is stored on Mailingwork's servers in Germany.

We have concluded a contract for order processing with Mailingwork. Through this contract, Mailingwork assures us that they will process the data on our behalf in accordance with the General Data Protection Regulation and ensure the protection of the rights of the data subjects.

Mailingwork assures that personal data is fully protected against unauthorized access. Mailingwork itself does not use the data of the registered persons to contact them directly or share the data with third parties. As a reputable email sender, mailingwork is also certified by the Certified Senders Alliance.

In addition, it may be necessary in the context of the contract performance to transmit your personal data to an external organizer. In connection with an event registration, you will be informed in such a case about who the organizer is and whether it is an external organizer. This person will process personal data in the context of the event and in particular for participant management.

To visually document the event, photos and videos will be taken. It cannot be ruled out that you may be directly or indirectly identified in the recordings, so that this constitutes personal data.

The recordings are created for Fraunhofer and used for news directly related to the event and for internal and external reporting by and through Fraunhofer.

In addition, the recordings will be published for post-event reporting on our media platforms such as Instagram, Twitter, LinkedIn, etc. or our website. This processing is particularly necessary to document our event and promote future events.

The data processing is based on Art. 6 para. 1 sentence 1 lit. f GDPR. The mentioned purposes are legitimate interests within the meaning of the aforementioned provision.

The recordings will be stored for 2 years.

c) When registering for our press distribution list

If you have expressly consented to this in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR, we will use your email address to regularly send you our press news. For the receipt of press news, we collect the following mandatory information:

  • Email address

You may voluntarily provide additional information about yourself (e.g. company and telephone number). We use this data to contact you by telephone or post.

After registering, you will receive a registration notification by email, which you must confirm in order to receive the press newsletter (so-called double opt-in). This serves as proof that the registration was actually initiated by you.

Unsubscribing is possible at any time, e.g. via a link at the end of each press newsletter.

Your email address will be deleted immediately after revocation of your consent to receive the newsletter.

We send our press information by means of the provider [mailingwork GmbH, Birkenweg 7, 09569 Oederan ("mailingwork"). The email addresses of our newsletter recipients are stored on mailingwork's servers in Germany on our behalf.

Mailingwork uses this information for sending and evaluating newsletters on our behalf. We have concluded a contract for order processing with mailingwork for this purpose. Through this contract, mailingwork assures us that they will process the data in accordance with the General Data Protection Regulation and ensure the protection of the rights of the data subject.

Mailingwork assures that personal data is fully protected against unauthorized access. Mailingwork itself does not use the data of our newsletter recipients to contact them directly or share the data with third parties. As a reputable email sender, mailingwork is also certified by the Certified Senders Alliance.

d) When registering for a newsletter or other distribution list

We offer various options on our website to subscribe to a newsletter, service offerings and research activities, or emails for publications. If you have expressly consented to this in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR, we will use your email address to regularly send you information corresponding to your selection. The following information is mandatory for receiving the information:

3. Disclosure of personal data to third parties

Except in the cases mentioned above (registration for events, registration for press distribution list, registration for a newsletter), we only pass on your personal data to third parties if:

  • You have given your express consent to this in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR,
  • this is necessary for the fulfillment of a contract with you in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR,
  • there is a legal obligation to do so in accordance with Art. 6 para. 1 sentence 1 lit. c GDPR.

If personal data is transmitted to a third country (outside the EU) or an international organization, this will be indicated separately.

 

4. Web analysis using Leadlab (Wiredminds GmbH)

On our website, we use the Leadlab service from Wiredminds GmbH and their counting pixel technology for analyzing user behavior and optimizing our site based on that. In particular, the service allows us to identify which companies have visited our site. We do not receive any information that directly identifies you.

In connection with the use of Leadlab, counting pixels are used that enable statistical analysis of the use of this website through your visits. The information is processed by Wiredminds using a pseudonym in a usage profile for analysis purposes and anonymized as much as possible.

The data obtained in this way will not be used to personally identify you without your separate consent, and the data will not be merged with personal data about you as the pseudonym bearer.

If IP addresses are collected, they will be anonymized immediately after collection by deleting the last block of numbers.

The data processing is based on our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR in optimizing our online offering and our web presence. Wiredminds processes the data on our behalf, and we have concluded an order processing agreement with Wiredminds. This ensures that data processing on our behalf is in accordance with the General Data Protection Regulation and ensures the protection of the rights of the data subjects.

 

5. Social Plugins

We use so-called social media buttons (also social media plugins) on our website. These are small buttons that allow you to publish content from our website on social networks under your profile. If you activate such a button, a connection is established between our website and the social network. In addition to the relevant content, the operator of the social network receives further partially personal information. This includes, for example, the fact that you are currently visiting our site. The social media buttons are integrated using the so-called Shariff solution. This solution prevents a connection to a social network from being established just because you visit a page with a social media button without activating it. This means that information is only transmitted to the social network when you use the button. We use the following social media plugins:

a) X (formerly Twitter): Sharing by X Corporation

Information may be transferred to the parent company X Corp. based in the USA, other X companies, and external partners of X who may be located outside the European Union. X uses standard contract clauses approved by the European Commission and relies on your consent. Further information on data protection at X can be found in the X privacy policy.

b) LinkedIn: Sharing by LinkedIn Unlimited Company

Information may be transferred to the parent company LinkedIn Corporation based in the USA, other LinkedIn companies, and external partners of LinkedIn who may be located outside the European Union. LinkedIn uses standard contract clauses approved by the European Commission.

c) Instagram: Sharing by Meta Platforms Ireland Limited

Information may be transferred to the parent company Meta Platforms Inc. based in the USA, other Meta companies, and external partners of Meta who may be located outside the European Union. Meta uses standard contract clauses approved by the European Commission and relies on adequacy decisions adopted by the European Commission regarding certain countries.

The purpose and scope of data collection, as well as the further processing and use of data by Meta and your rights and settings options for protecting your privacy, can be found in the privacy policy of Instagram.

 

6. YouTube

On our website, we use the video portal "YouTube" from the company Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter: "Google"). The implementation is based on Art. 6 para. 1 sentence 1 lit. f GDPR, with our interest being in the smooth integration of the videos and the appealing design of our website.

Here, we use the "extended privacy mode" option provided by Google.

When you access a page that has an embedded video, a connection is made to the Google servers and the content is displayed on the website by notifying your browser.

According to Google, in "extended privacy mode," only your data - in particular, which of our web pages you have visited and device-specific information including the IP address - is transmitted to the YouTube server in the USA when you watch the video. By clicking on the video, you consent to this transmission.

If you are logged into Google at the same time, this information will be associated with your membership account at YouTube. You can prevent this by logging out of your membership account before visiting our website.

Information may be transferred to the parent company Google Inc. based in the USA, other Google companies, and external partners of Google who may be located outside the European Union. Google uses standard contract clauses approved by the European Commission and relies on adequacy decisions adopted by the European Commission regarding certain countries.

7. Rights of data subjects

You have the right:

  • According to Art. 7 para. 3 GDPR to revoke your consent given to us at any time. This means that we may no longer continue the data processing based on this consent in the future;
  • According to Art. 15 GDPR to request information about your personal data processed by us. In particular, you can request information about the purposes of processing, the categories of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it has not been collected by us, and the existence of automated decision-making, including profiling, and, if applicable, meaningful information about the details of such processing;
  • According to Art. 16 GDPR to demand the immediate correction of incorrect or completion of your personal data stored by us;
  • According to Art. 17 GDPR to demand the deletion of your personal data stored by us, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;
  • According to Art. 18 GDPR to demand the restriction of processing of your personal data, if the accuracy of the data is disputed by you, the processing is unlawful, but you oppose their erasure and we no longer need the data, but you require it for the establishment, exercise or defense of legal claims or you have objected to processing pursuant to Art. 21 GDPR;
  • According to Art. 20 GDPR to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request transmission to another controller; and
  • According to Art. 77 GDPR to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters for this purpose.

 

8. Information about your right to object according to Art. 21 GDPR

You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you which is based on Article 6(1)(e) GDPR (processing in the public interest) or Article 6(1)(f) GDPR (processing for the purposes of legitimate interests), including profiling based on those provisions.

If you object, we will no longer process your personal data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.

If the objection is directed against the processing of data for direct marketing purposes, we will immediately stop the processing. In this case, no special situation needs to be stated. This also applies to profiling, insofar as it is associated with such direct marketing.

9. Data security

All data transmitted personally by you is encrypted with the generally accepted and secure standard TLS (Transport Layer Security). TLS is a secure and proven standard used, for example, for online banking. You can recognize a secure TLS connection, among other things, by the attached "s" in http (i.e. https://..) in the address bar of your browser or by the lock symbol in the lower area of your browser.

In addition, we use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

 

10. Timeliness and modification of this data protection information

This data protection information is currently valid and has the status of November 2023.

Due to the further development of our website and offers via it or due to changed legal or official requirements, it may become necessary to change this data protection information. The current data protection information can be accessed and printed out by you at any time on the website at https://www.enas.fraunhofer.de.
